State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The reasons for a judgment are tainted by defective inference if they contain something that impairs the soundness of the deduction. Instances thereof. Reliance on evidence unsuitable for forming a conviction, failure to understand the factual elements, or a contradiction between them, as where the conclusion reached by the judgment on their basis does not follow logically. Example: the judgment's inference from reinstatement of the action after its striking out that the settlement had been repudiated and withdrawn from, although such reinstatement does not, by itself, indicate that, which vitiates it and requires its cassation. - The settling party's right to plead extinguishment of the dispute by settlement if the other party renews the dispute concerning the settled right, whether by proceeding with it or bringing a new action concerning it.
