Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3450

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Liability of the custodian of things. Its basis is presumed fault not admitting proof to the contrary. Negation of this liability. Its condition. Proof by the custodian that the damage occurred through an extraneous cause. The nature of an extraneous cause. - Assessment of the existence or absence of an extraneous cause. Within the authority of the court of merits. Its condition: that it base its ruling on reasonable grounds sufficient to support it. - The challenged judgment's justification of its ruling—that the vehicle driver was liable as custodian of things—by matters insufficient to establish a causal relationship between the act of the thing and the occurrence of damage and the absence of an extraneous cause, while acknowledging the injured party's fault. Defective reasoning and error in applying the law.
