Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3456

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The element of causation in tort liability. It rests on the effective, operative cause producing the damage, not the incidental cause—which plays no part in producing the damage—even if it contributed by coincidence to its occurrence through being associated with the operative cause. - Negligence of the security monitoring committee overseeing the examination committee, which facilitated the assailant's entry into the committee and his assault on the appellant and infliction of his injuries. An incidental cause not inherently capable of producing that injury: the consequence thereof: absence of the element of causation giving rise to the State's liability for the damage resulting from the injury.
