Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3619

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that custody of a thing belongs to its owner. His liability to compensate for damage resulting from the accident is presumed. The bursting of one of the vehicle’s tyres is not an external cause severing the causal link between the act and the damage. This is not altered by issuance of a decision shelving the investigation into the negligent killing incident. Rationale: decisions issued by the investigating authority have no binding effect before the civil courts, whatever their content or the grounds upon which they were based. - 666 - Obligation
