استعمال الحق استعمالاً مشروعاً. أثره. لا مسئولية عن الضرر الناشئ عنه. - استعمال الحق استعمالاً غير مشروع. حالاته: إذا لم يقصد به سوى الإضرار بالغير، أو كانت المصلحة التي تترتب عليه لا تتناسب البتة مع الضرر الذي يلحق بالغير أو إذا كان من شأنه أن يلحق بالغير ضرراً فاحشاً غير مألوف. مثال.Original Arabic judgment citations
