Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3759

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The direct actor. What is meant thereby. Direct causation differs by its nature from indirect causation, which is a cause of the event but does not itself bring it about. - The victim, while playing beneath the insured car, collided with its front and fell to the ground at the moment the car moved, whereupon its rear tyres passed over his head and body when it was moved, causing the injuries that led to his death. The import of this. Its driver was an indirect causer, not a direct actor. The reason for this. Another act intervened between the car driver’s act and the damage, namely the victim’s collision with the front of the car and his fall.
