Kuwait Court of Cassation principle number 3798

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The direct actor in Islamic jurisprudence. His definition. The distinction between direct action and indirect causation. - The movement of a vehicle is the act of its driver because it results from his activity. He is regarded as the direct actor in respect of every harm resulting from that movement. Example. The accident occurring as a result of the driver's activity consisting of driving it and its overturning while in motion. This means that the vehicle's movement itself brought about the damage, a conclusion unaffected by the bursting of its tire. - The bursting of a vehicle's tire while it is being driven. A fortuitous event that does not avert the direct actor's liability.
