Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3799

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The direct actor is the person whose act, which he performed himself, itself brought about the damage and was its cause without an intermediary or the intervention of a matter between the act and the damage resulting directly from it; the indirect causer, however, is the person who was a cause of the matter but did not bring it about himself. - The direct actor's liability is not based on fault but on directly causing the damage, and is not removed merely by the occurrence of fault on the part of the injured person; rather, it is removed if the injured person deliberately injured himself or the injury befell him as a result of gross and intentional misconduct on his part.
