Definition of the direct actor. - The direct actor's liability is founded on directly causing harm, not on fault. Effect thereof. His liability is not excluded by the absence of fault on his part or merely by fault on the part of the injured party, unless the injured party intentionally injured himself or as a result of gross and deliberate misconduct on his part. An example of an untenable inference.
