State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Guarantee of personal injury. Its financial burden falls upon the person who directly inflicted it, in accordance with Islamic Sharia provisions and the contents of the blood-money schedule. - The direct actor in Islamic jurisprudence. Definition. A person whose act, personally performed, itself brought about the damage and caused it without an intermediary. Direct action differs from indirect causation. - 703 - Obligation - The movement of a vehicle is the act of its driver because it results from his activity. He is considered the direct actor in respect of every harm resulting from that movement. A judgment contrary to this is defective. Example. The judgment’s finding that the deceased’s fault was established by his crossing the road intersection against the red light, leading to the accident that claimed his life, and that this constituted gross misconduct on his part capable of negating the respondent driver’s characterization as the direct actor.
