State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The direct actor. Its definition and what distinguishes it from indirect causation. - Determining whether the direct actor's act has itself brought about the harm without an intermediary, or negating that. A matter of fact. - Proof that an unidentified vehicle struck the appellant's vehicle from behind, causing it to collide with a lamppost, thereby injuring the respondents' deceased predecessor, who was accompanying the appellant, and causing her death. Import thereof. The harm did not arise directly from the vehicle driven by the appellant, but rather from the intervening collision caused by the unidentified vehicle with the vehicle driven by the appellant. Effect thereof. The appellant bears no liability as a direct actor. The challenged judgment's departure from this renders it defective and requires its cassation.
