Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1461

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Assignment of a right. Its formation. Consent of the debtor against whom the right is assigned is unnecessary. Reason: the assignment does not create a new obligation in his liability but transfers the obligation originally established against him from one creditor to another. - The assigned right. Its transfer with all its constituents, characteristics, and actions affirming it. - Transfer of the right to the assignee subject to extinction by the period by which it expires. The debtor may plead extinction against the assignee or assignor.
