Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1462

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Evidence submitted by a litigant to substantiate the validity of his claim, if it consists merely of his statements and allegation, a paper issued by him, or information he recorded himself. It is not legal evidence. The reason therefor: he cannot himself create for himself a basis for a right he acquires. The effect thereof: the claimed right that is not established by its legally recognized evidence is equivalent to nonexistence - 276 - Obligation. Example concerning a transfer made by the respondent and not bearing the appellant’s signature, which does not constitute legally recognized written evidence for purposes of proof. The challenged judgment’s failure to address the appellant’s plea that writing may be proved only by writing, and its statement that the transfer of sums suffices to prove the debt in writing without recognizing that it does not constitute written evidence. A violation of the law and an error in its application.
