Kuwait Court of Cassation principle number 1646

The contractor's obligation is an obligation to achieve a result: that the building he erected remain sound and solid for ten years - as a general rule - from completion of the building or construction. Article 692 Civil Code. Proof that this result was not achieved establishes breach of this obligation without the need to prove any fault. Condition thereof: the existence of a contract for works under which the employer entrusted a contractor with executing a fixed building of any kind.
