Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 199

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An action for compensation for preventing the possessor of immovable property from possessing it. The defendant therein is anyone who commits a positive act upon the property leading to that prevention. It suffices that the possessor’s possession be current physical possession, with his control actually connected to the property and existing at the time of prevention, placing the person preventing possession in the position of one who takes the law into his own hands without resorting to the courts. Example of the defendant’s standing by reason of changing a chalet’s key with the intention of preventing possession thereof.
