Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2047

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Abandonment giving rise to the barring of an action from being heard under Islamic Sharia is leaving the property while grounds for an action exist owing to another’s usurpation of it, encroachment upon it, and denial of its owner’s right. Barring the action from being heard is not based on invalidity of the right; rather, it prohibits the judge from hearing it while the right remains with its holder, and if it is acknowledged, it becomes binding upon the person acknowledging it.
