Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2719

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court’s obligation to examine a challenge alleging absolute simulation. Its condition: it must be explicit in meaning, on the basis that the ostensible contract has no existence in reality. Merely alleging fraud and collusion between the parties to the sale contract does not constitute evidence of simulation of the sale contract.
