Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2721

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A challenge on grounds of absolute simulation. Must be explicit in meaning that the apparent contract does not in fact exist. A challenge on grounds of collusion and fraud. Does not convey that meaning. - A registered contract. Its priority over an unregistered contract. This is not altered by proof of collusion between the parties to the latter contract to deprive the first buyer. Knowledge on the part of the second buyer who registered his sale contract does not constitute a presumption that the sale is simulated. Example. - 527 - Sale
