Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2975

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Disposition of property held in common. Its condition. The majority must comprise at least two co-owners. A single co-owner may not perform any act reserved to the majority, whatever his share. The reason for this: what matters is a plurality of opinions. - It is established that the appellant's request for a judgment expunging and cancelling the registration of the contract insofar as it included the sale of his share in the property is in reality a request that that instrument be held ineffective against him insofar as it included the respondent's acquisition of the appellant's share, owing to the absence of the majority. The judgment's characterization of the action as an objection to the majority's notification of the disposition of the property and its determination of it on that basis. An error in application that prevented it from determining the appellant's claims according to their true nature.
