State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that a lawyer is an agent whose relationship with his client is governed by the provisions of the general law relating to the relationship between principal and agent. The provision in Article 32 of Law No. 42 of 1964 concerning the legal profession granting the judge authority to assess a lawyer's fees if the client disputes them. Amendment of that article by Law 62 of 1996 and removal of the previous provision concerning assessment of a lawyer's fees where disputed mean that the legislator intended to leave this matter to the provisions of the general law, namely the Civil Code provisions on agency, since there is no conflict. Example.
