State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Allocation of government houses. A stage preceding transfer of their ownership from the State to individuals. Its implication: the allottee acquires only the right of residence, not ownership, which does not transfer to him merely upon payment of the price in full and fulfillment of the other conditions stipulated in the housing welfare system. Transfer of ownership. Its requirement. Submission of an application for issuance of a title deed and approval of that application by the competent administrative authority after fulfillment of the conditions for transfer of ownership, including the condition of forming a family consisting of a Kuwaiti husband and wife, or one of them and one of the Kuwaiti children, in accordance with the laws and decisions in force. Adherence to this concept when initially allocating houses or amending the allocation. Valid issuance of the deed in accordance with these procedures and conditions and to those actually entitled thereto. Its effect. Transfer of ownership of the dwelling to them.
