Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4255

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Management of common property belongs to the manager whose appointment is agreed upon by those owning the majority of the shares. Their failure to appoint a manager and one co-owner's individually undertaking one of those acts. The effect thereof: he is deemed, in what he has undertaken, a representative of all. The condition therefor: that the majority does not object in due time. - A co-owner in indivision bringing an action for vacation and delivery of the property. This falls within management of the common property and suffices to establish his standing to bring it. The judgment's departure from this. An error in applying the law requiring its cassation.
