English translation of the principle

Leasing jointly owned property. A right of the majority of the co-owners. A lease of the entire property or a physically separated part thereof granted by one co-owner who does not hold a majority of the shares. Valid and effective between him and his lessee, but not against the other co-owners unless the majority ratifies it expressly or implicitly. This is established by their failure to object to what their co-owner has done. He is regarded in this case as their representative. - A private contract. Binding evidence against its parties as to the particulars recorded therein. The condition for this: it must bear a signature that is not denied. The reason for this. - Establishment that the lease was concluded between the appellant as lessee and the respondent as lessor. The contract containing an authorization for the latter to undertake litigation procedures concerning disputes arising from it. The challenged judgment’s conclusion rejecting the plea that the action is inadmissible because it was brought by a person lacking full capacity to sue. Correct.
