Kuwait Court of Cassation principle number 4331

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The tenancy right arising from a lease contract. A movable right even if the subject of the lease is immovable property. The lessor's intervention to enable the lessee to use the leased premises. Its import. It is a personal right. It is not subject to the provisions governing co-ownership in undivided shares, including partition of co-owned property in both its forms, whether partition in kind or partition of enjoyment. - The right of usufruct. Its nature. Its difference from a tenancy right, as it is a financial right existing in itself that may be valued and divided among co-owners in undivided shares. Its import. The lessee's lack of entitlement to partition the leased premises differs in essence from the right of the State Property Department, derived from the decision of the Committee for the Exploitation of State Lands Outside the Planning Boundary—concerning the controls and criteria specific to chalets and the governing implementing regulations—to carry out subdivision of the entire licensed land area at the request of the licensees and prepare a new plan for each chalet.
