State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Possession of real property for 15 years, peacefully, openly and with the intention of ownership, constitutes, under the system of barring the hearing of actions, a Sharia and legal presumption that the possessor is its owner. - Establishing possession of real property and assessing the presumptions and evidence that do or do not establish it as a presumption of ownership. Within the authority of the court of merits, which may adopt the expert's opinion and the testimony of witnesses he heard. - Mere abandonment of the property, however long, without anyone interfering with it or usurping it and denying its owner's right therein does not, under the system of the Majalla of Judicial Rules, result in lapse of the right of ownership thereof.
