Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 626

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judgment awarding provisional compensation that did not determine the extent of the damage or the amount of compensation. Its acquisition of res judicata force. Its effect. It encompasses liability in its various elements, establishes the compensation debt in its origin and basis, has binding authority between the litigants, and confirms indebtedness affirmatively or negatively. The debt established by the judgment may not be confined to what appears in its operative part; rather, it must extend to the elements of assessment encompassed by the subject matter of the debt, even through a subsequent action brought by the injured party for the same debt to complete it and determine its amount.
