Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1383

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A conclusive judicial judgment has the authority of res judicata from the day of its issuance even if it is open to challenge. The effect thereof. Appealing it renders this authority temporary pending determination of the appeal; if the judgment is affirmed, its authority returns, and if reversed, it ceases. The Court of Appeal is not bound by that authority. The criterion therefor.
