Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1384

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The requirement that the defendant or respondent have standing in actions for annulment of administrative decisions. It concerns public order. Its effect. The court may address and examine it and rule upon it of its own motion when applying the law to the administrative dispute as to both form and substance and at any stage of the action. - The appellate court may rule that the action is inadmissible so long as it has established grounds for inadmissibility, even if the appealed judgment overlooked them. The reason therefor. A judgment against an administrative body requiring what cannot readily be implemented or what its budget cannot bear merely because it was joined as a party contravenes public order, even if it did not plead lack of standing.
