Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1441

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Court of Appeal may adopt an approach to assessing maintenance different from that of the court of first instance. Its response to that court's evidence. Not required. It suffices that its view has an established basis in the case papers and is justified. - The litigants' request for an evidentiary inquiry in the action to establish particular facts: not a right of theirs. The court may disregard it whenever it finds sufficient material in the papers to form its conviction. An example concerning the Court of Appeal's increase of the spousal maintenance imposed by the judgment of the court of first instance and its refusal of the request to refer the appeal for an evidentiary inquiry to establish and the correctness of the appellant's defence.
