Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1454

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The plea that the period prescribed by law for bringing the action has expired. A substantive plea of inadmissibility concerning the right to bring the action as a right separate from the right for whose protection it was brought. Its lack of connection with public policy. This does not preclude invoking it at any stage of the action, even for the first time before the appellate court. The reason for this. Article 452, Civil Code.
