Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 36

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Recourse to the general law is only in respect of provisions omitted by the special law. The reason for this. - Special legislation is an exception to the legislation preceding it only insofar as it specifically provides. - Subsequent general legislation does not impliedly repeal earlier special legislation.
