Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 543

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The existence of a special law. Its effect. No recourse is had to the provisions of the general law in matters not regulated by the special law. The reason for this. The special legal rule does not repeal the general rules but constitutes an exception to them, so both enactments continue to operate together, each within its scope. The effect of this. The rule that an employee transferred from one entity to another retains the last salary he received before his transfer, established by special legislation and conflicting with the rule regulated by general legislation making the salary of the job grade to which the employee is transferred the criterion for determining his salary, is the rule that must be followed, so that the purpose for which the special law was enacted is not defeated. The judgment's adherence to this. No defect.
