Kuwait Court of Cassation principle number 544

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Public markets designated for public benefit. Their occupation is in return for a fee, not rent, and under temporary licenses that are not binding on the licensing authority, which may cancel or revoke them before their expiry for reasons of public interest. These licenses have the character of administrative contracts and are governed by the conditions contained therein and the rules regulating this type of undertaking. All of this constitutes administrative acts governed by public law and not subject to private law or the restrictions it imposes. Jurisdiction to hear any dispute concerning them lies with the Administrative Circuit of the Court of First Instance.
