Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 547

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Periodic leave. Granted only upon the employee’s request. An employee may not use more than ninety days of the employee’s accumulated periodic leave in a single year. Upon termination of service, the employee is paid a cash allowance for the remaining unused balance, not exceeding ninety days. The judgment’s contravention of this rule, resulting in calculation of the leave taken by the respondent as exceeding the balance permitted by law. Renders it defective.
