English translation of the principle

A grant or bonus. It is considered part of wages if the employer undertakes to pay it in the employment contract, a subsequent agreement, the work regulations, or pursuant to custom. The condition for this: regularity in granting it and the belief that it is obligatory. Fulfillment of that condition. Its effect. The grant is considered part of wages and included in calculating the end-of-service gratuity. - The establishment of any right or benefit for the worker under the work regulations makes those regulations the basis for calculating the end-of-service gratuity, even if they differ from the Labour Law. The reason: they are more beneficial to the worker, even if the regulations postdate the employment contract. An example concerning granting a worker permanent free shares and including them in calculating the end-of-service gratuity. - 463 - Civil Procedure
