Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 693

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Acts of sovereignty which the courts lack jurisdiction to hear. Determining their nature. Left to the judiciary. - Acts of sovereignty emanate from the government in its capacity as a governing authority, not in its capacity as an administrative authority. Their purpose is to achieve the nation's interest, security and safety. They therefore require no judicial review or extension of judicial oversight over them. - The Ministry of Social Affairs' decision to transfer residency from one sponsor to another and the refusal of a transfer application do not fall within acts of sovereignty. Its effect: the judiciary has jurisdiction to hear it.
Arabic original
