Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 962

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Subject-matter jurisdiction is, in principle, attributed to the court, not to its circuits. Assignment of particular actions to the court's circuits by a resolution of its general assembly. Does not constitute subject-matter jurisdiction, but merely an administrative distribution of work among those circuits, to which the description of the Court of First Instance applies and which have jurisdiction to adjudicate the dispute even if the assembly assigned it to another circuit. The exception. Cases in which the law, by a special provision, singles out one of the court's circuits for jurisdiction to hear particular matters. This does not preclude its jurisdiction to hear other matters falling within the court's subject-matter jurisdiction. Example concerning the jurisdiction of the Tenancy Circuit of the Court of First Instance and its not being deprived of jurisdiction to hear matters other than tenancy disputes as one of the court's circuits. - 548 - Civil Procedure
