Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1380

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The binding authority of judgments. Confined to the parties to the litigation, to the exclusion of others, in application of the rule of the relative effect of judgments, which prevents anyone from benefiting from or being prejudiced by a judgment to which he was not a party. - Judgments rendered against a predecessor bind the successor regarding the right received from him. Judgments rendered against a particular successor, however, have no binding authority against the grantor of the right if the latter was not made a party to the action.
