Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1912

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A claim overlooked by the court. How to remedy it. Recourse to the same court. A cassation appeal on account of this omission is impermissible. The reason therefor. An appeal is admissible only in respect of claims that have been determined. What does not alter this: the court’s statement, “and dismissed all other claims.” The reason therefor: this phrase applies only to claims examined in the judgment and does not extend to what the court did not address expressly or implicitly.
