Kuwait Court of Cassation principle number 1931

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court must not depart from the scope of the action, its judgment must not exceed the limits of the claims placed before it, and it must adhere to their cause and confine its examination to it. - The litigant’s claims being confined to a request to appoint an expert in preparation for requesting a judgment declaring him free of the indebtedness and lifting the measures taken against him. The scope of this action is confined to preparing evidence in it. The expert’s submission of his report without substantive claims being made. The action has achieved its purpose and must be declared ended. The judgment’s contravention of that and its addressing the merits. A violation of law requiring its cassation.
