Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2120

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The time limit for bringing an action to annul an administrative decision. Sixty days. This time limit is interrupted by a grievance to the authority issuing the decision or its superior authority. The time for submitting the grievance. Before the expiry of this time limit. A complaint submitted to an authority other than this authority, such as the State Commissioner or the Legal Affairs Department of the entity to which - 389 - Procedure the complainant belongs, is not considered a grievance. What counts for commencement of the time limit is its actual receipt by the competent authority. No account is taken of any receipt or paper issued by an authority other than the competent authority concerning the date of receipt of the grievance. - The lapse of sixty days from the date of submission of the grievance without a response to the complainant is deemed a decision rejecting it. The complainant must bring the annulment action within sixty days from that date. Bringing the action after the specified time limit renders it procedurally inadmissible.
