State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The jurisdiction to annul administrative decisions vested in the Administrative Circuit. Its limitation to the decisions stipulated in Article (1) of Law 20 of 1981 establishing an Administrative Circuit at the Court of First Instance. Other administrative decisions not covered by the text of the aforementioned Article. An application for their annulment falls outside the jurisdiction of the Administrative Circuit and the other circuits of the Court of First Instance, whose jurisdiction originally excludes hearing administrative disputes. The reason for this. - A court ruling that it lacks jurisdiction is under no obligation to refer the action to another circuit or another body. The condition for this: that it ascertain, pursuant to law, that jurisdiction and competence to hear the dispute vest in that circuit or body. When it confines itself to ruling that it lacks jurisdictional authority.
