Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2703

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

It is not sufficient for a person joined in a challenge to have been a party to the proceedings in which the judgment was issued. He must have been a genuine adversarial party therein. An example concerning a party who adopted a passive position in the proceedings, against whom no claims were directed, in whose favour or against whom nothing was adjudged, and to whom the grounds of challenge did not relate.
