Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2746

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A ruling staying proceedings pending determination of another issue outside the court's functional or subject-matter jurisdiction: its prerequisite: that issue must be preliminary and necessary to determine the action. The court having sufficient grounds to determine the action without awaiting determination of that issue. The court must proceed to determine it, there being no legal justification for a stay pending such determination. Its departure from this. An error in the application of the law.
