Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4214

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Acts of sovereignty. Their nature. - Assessment of what constitutes acts of sovereignty and falls outside judicial review. Within the power of the courts. An example concerning - 778 - Civil Procedure a plea of lack of jurisdiction. - The impossibility of members of the judiciary returning to work throughout the invasion period and their deprivation of their salaries constitute war damage, which constitutes acts of sovereignty. The effect thereof is that the Ministry of Justice is not liable for any damage arising therefrom. The Kuwaiti government’s payment of grants and wages to its nationals does not alter that. The reason therefor.
