Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4225

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A plea of inadmissibility is a matter preceding determination of the merits. Whenever the court decides to join them together, it must alert the parties to present their defence on the merits of the dispute. And if each of them causes, without requiring a particular order.
