English translation of the principle

Waiver of a plea or defense. Its condition. It must admit of no other interpretation. An example of what does not constitute a waiver. - A litigant's insistence in his memorandum on the plea that the appeal be deemed never to have existed, while requesting dismissal of the appeal and affirmation of the judgment appealed against. The memorandum contains nothing indicating his express or implied waiver of the plea. The judgment's conclusion to that effect. No defect. - 782 - Civil Procedure
