Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4251

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of first instance’s ruling being confined to determining a procedural plea in the action. Its effect. It has not exhausted its jurisdiction over the merits. Reversal of its judgment. Its implication. The court of second instance must remit the case to it for consideration of the merits. This concerns public policy. Its failure to do so taints its judgment with an error in the application of the law, requiring its cassation.
