Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4414

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court’s determination of one of the issues before it. Its effect. Exhaustion of its authority in respect thereof. It must abide by what it has adjudged when addressing the remaining issues before it in the action. This is not altered by whether or not the judgment issued on that issue is independently appealable. An example concerning rejection of a plea of unconstitutionality. - An appeal against the judgment on the merits of the action necessarily entails an appeal against all judgments previously issued. A rule that does not apply to an appeal by cassation. - 811 - Civil Procedure
