Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4417

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Forfeiture of the right of pre-emption upon expiry of the period prescribed in Article 903/b of the Civil Code, which begins on the date of registration of the contract for sale of the immovable property. Falls within the legislature's authority to regulate the procedures and arrangements necessary for exercising the right to litigate concerning pre-emption. The appellant's failure to specify how that regulation contravenes the Constitution and the legal basis for this. Its effect: the plea of unconstitutionality of the aforementioned provision is not serious.
